The ongoing controversy, which has dogged Babiš throughout his political career, centers on accusations that he improperly benefited from European Union subsidies while simultaneously holding a controlling interest in a company receiving those funds.
The latest challenge comes from Transparency International Czech Republic, which is demanding Babiš publicly disclose the articles of association for his newly established RSVP Trust. The organization alleges the trust is a thinly veiled attempt to maintain influence over Agrofert’s access to subsidies and government contracts, despite Babiš’s repeated pledges to resolve his ownership conflicts.
According to David Kotora, executive director of Transparency International, the structure of the trust raises serious concerns. “Everything suggests that this new trust fund was created solely to maintain Babiš’s influence on subsidies and contracts for the Agrofert holding, while he remains in office as prime minister,” Kotora said. He further noted that provisions stipulating the shares be passed down to Babiš’s children demonstrate a continuing personal financial stake.
Accusations of Obfuscation and Delays
Babiš responded to the calls for transparency with a familiar tactic: dismissing the allegations as politically motivated and attacking the credibility of Transparency International. He labeled the anti-corruption organization a “corrupt non-profit” allegedly paid to attack him.
The prime minister also claimed he is unable to release the trust’s articles of association because he did not personally establish the fund. Kotora countered this assertion, stating that Babiš initiated the fund’s creation and can dispel doubts about its operation only through full disclosure. This exchange underscores the ongoing difficulty in obtaining clear answers regarding Babiš’s financial arrangements.
Adding to the complexity, Babiš has yet to transfer shares of Agrofert into the trust, citing a need for document verification from three European Union countries. He also indicated that his second holding company, SynBiol, will not be included in the trust at all. The delays raise questions about the sincerity of Babiš’s efforts to address the conflict of interest.
Legal experts point out that companies controlled by a member of the government are prohibited from receiving subsidies and public contracts from the moment the individual assumes office. Failure to resolve the conflict transparently could lead to legal repercussions for Babiš and potentially escalate tensions with the Presidential Office, which conditioned his appointment on a clean record.
The situation is further complicated by recent scrutiny of Babiš’s relationship with Foreign Minister Petr Macek. While previously distancing himself from Macek’s controversial reports to the president, Babiš now publicly praises their collaboration and emphasizes their frequent communication. He dismissed opposition criticism and motions of no confidence, attributing the relationship to the outcome of the elections. This development highlights the prime minister’s willingness to defend allies facing criticism, even as he navigates his own ethical challenges.
