“Car Complaints”:
Dag Rune Flåten has again lost a legal battle against Møller, and Volkswagen. He is now considering appeals to both the Supreme Court and ESA.
Borgarting Court of Appeal has dismissed the appeals filed by Dag Rune Flåten and his company.
– The Court of Appeal agrees with the District Court’s assessment,” Borgarting Court of Appeal stated in two identical rulings.
Flåten has repeatedly attempted to bring lawsuits against Volkswagen and its Norwegian importer, Harald A. Møller, alleging wrongdoing related to the German automaker’s diesel emissions scandal.
However, the legal system has consistently rejected these claims, including a previous ruling by the Supreme Court in the fall of 2024.
The businessman, who has resided abroad for many years, remains undeterred. He revised the class-action lawsuit and attempted a new approach.
This time, he divided the class action into four separate cases, securing four vehicle owners to formally represent a total of 8,500 diesel vehicle owners.
Withdrew Appeal
All four lawsuits were dismissed in Oslo District Court last summer. All rulings were appealed, but two of the appeals were withdrawn in December of last year.
The Court of Appeal has now issued rulings on the remaining two cases.
The four individuals who fronted the lawsuits have been ordered to pay Volkswagen AG and Harald A. Møller 445,000 Norwegian kroner in legal costs for the Court of Appeal proceedings alone.
This is in addition to legal costs exceeding one million Norwegian kroner, which they were previously ordered to pay for the Oslo District Court proceedings.
Considering ESA Complaint
Dag Rune Flåten and his complaint company are not conceding defeat.
In a newsletter sent to vehicle owners who have registered with him, he promises that the Court of Appeal’s decisions will be appealed to the Supreme Court.
He is as well considering filing a complaint with ESA, the EFTA Surveillance Authority, arguing that the dismissal violates the rules of the European Economic Area (EEA). EFTA ESA
A possible appeal to the European Court of Human Rights is also mentioned in the newsletter.
The newsletter also states that he is in the process of creating a European version of his complaint website, Bilklager.
He promises a welcome gift to Norwegian vehicle owners who register on the European website.
Both NAF and the Norwegian Consumer Council have warned vehicle owners against participating in Flåten’s numerous legal processes, believing they have little to gain from the cases against Volkswagen and Møller.
