– Det er sendt begjæring til Oslo tingrett om løslatelse, sier forsvarer Ellen Holager Andenæs til Aftenposten, som omtalte saken først.
To dager før the trial began, Marius Borg Høiby (29) was arrested, and the day before the trial, he was remanded in custody.
The reason for his detention is concern about the risk of repeating offenses.

The weekend before the trial, Høiby was accused of a new violation of the restraining order against the Frogner woman, one of six alleged victims in the case. He was also accused of violence and threatening her with a knife, leading to a new charge of reckless behavior and violating a restraining order.
Høiby has admitted to the allegations, and they have been included in the ongoing trial against him.
According to Nettavisen, Andenæs explained why Høiby wants to be released.
– Høiby wants to be released because he does not wish to be in jail. But I do not want to comment further on this now. All I can add is that the request has been sent to the district court and will be processed in writing, and it should go quickly, Andenæs told Nettavisen.

She insists there is no reason to worry about the risk of re-offending.
– Høiby wants to be released because he does not want to be in jail and will not do anything wrong if he is released.
Last week, Nettavisen reported that Høiby’s restraining order against the woman, known as the “Frogner woman,” was extended for another six months, until September 2nd.
Police attorney Andreas Kruszewski confirmed to Nettavisen that they have received the request, but that they do not wish to release Høiby themselves.
– The prosecution confirms receipt of this. We have considered this and decided not to release him on our own initiative. This will therefore be forwarded to the Oslo District Court for further processing. It was only recently that the district court dealt with the detention hearing for Høiby and concluded that there was grounds for detention, Kruszewski wrote in a text message to Nettavisen.

Detention Could Last Several Months
In court, Høiby and his defense team have described a difficult situation with isolation in jail. This is due to the charges of rape, which are not well-regarded among other inmates.
Nettavisen has also learned that there are other security aspects that contribute to Høiby’s isolation.

According to the law, he can be held in jail for up to four weeks after sentencing, as regulated in the Criminal Procedure Act’s section 185.
– He is still remanded in custody until sentencing, and then we have another four weeks to request a possible extension, said police attorney Andreas Kruszewski.
Nettavisen asked the victim’s attorney, Mette Yvonne Larsen, for comment on Høiby’s request.
– I have no comment, the Frogner woman’s attorney wrote in a brief text message.
