The governor vetoed an article that would have allowed tax exemptions for equipment, and services.

São Paulo Governor Tarcísio de Freitas has signed legislation prohibiting condominiums and commercial buildings from blocking the installation of electric vehicle charging stations throughout the state. The move is intended to accelerate the adoption of electric vehicles by expanding charging infrastructure.
The law, numbered 18.403 and enacted on February 18, 2026, originated from a bill proposed by state representatives Marcelo Aguiar – PODE and Donato – PT. It was approved by the Legislative Assembly of the State of São Paulo (Alesp) on December 16, 2025.
According to the new regulations, costs associated with installation can be borne by the vehicle owner or shared among condominium residents. Installations must adhere to standards ensuring compatibility with the vehicle’s electrical load, the property’s capacity, and the local power grid.
Condominiums may only deny installation requests if they can demonstrate legitimate safety concerns. Properties approving installations will also need to plan for potential expansion to accommodate a growing number of electric vehicles and the associated energy demands.
However, Governor de Freitas vetoed Article 3, which would have authorized tax incentives for equipment and services, as well as other public benefits, including specific credit lines and partnerships with energy companies to develop shared technical solutions.
The vetoed article read:
Article 3º – The State may establish incentive programs for the installation of recharging infrastructure for
electric vehicles in residential and commercial buildings, through:
I – tax exemptions or reductions linked to installation;
II – specific credit lines through public financial institutions;
III – partnerships with electricity concessionaires for the development of shared technical
solutions.
The Brazilian Electric Vehicle Association (ABVE), representing manufacturers in the sector, released a statement indicating the law provides greater legal certainty for those considering purchasing a non-polluting vehicle.
“The new legislation will provide legal security to all sectors involved in the debate on electromobility and fire protection in commercial and residential buildings in São Paulo. It is a great advance,” said ABVE President Ricardo Bastos, according to the association’s statement.
