Madrid – A spanish court has moved to dismiss a case centered on allegations against Begoña Gómez, wife of Prime Minister Pedro Sánchez, following procedural challenges and the resignation of the representing counsel. The case, brought by the self-described “popular accuser” organization Clean Hands, has been beset by questions regarding its motivations and legal standing. This development highlights the complexities of navigating legal challenges with potential political ramifications in Spain, as well as the strict adherence to due process required in Spanish courts.

A Spanish judge has dismissed the Clean Hands organization, a self-described union, from a case involving Begoña Gómez, the wife of Spanish Prime Minister Pedro Sánchez. The move comes amid scrutiny of the group’s motives and tactics in pursuing the case, which centers on allegations of influence peddling.

Judge Juan Carlos Peinado ruled on April 24 that Clean Hands failed to provide proof of payment for a required deposit to participate as a popular accuser in the proceedings. The dismissal underscores the importance of adhering to procedural requirements in Spanish legal proceedings.

Lawyer Left Case Citing Political Motivations

Adding to the complexities of the case, Carlos Perales, the lawyer representing Clean Hands, announced his resignation on April 24, citing concerns that the organization’s decisions were driven by political considerations rather than legal strategy.

“The strategic decisions of the procedure are no longer inspired primarily by procedural logic or the solidity of legal arguments, but respond, to a large extent, to considerations of political opportunity, impact on public opinion or ideological positioning,” Perales stated in a resignation letter.

He further argued that this shift was “incompatible with the practice that governs the exercise of the legal profession, based on independence, technical rigor and strict adherence to objective legal criteria,” adding that the Spanish Code of Ethics for Lawyers requires attorneys to act with full independence, preserving the social function of the legal profession against external pressures.

Perales emphasized that his decision “was not taken lightly,” but rather followed “a careful analysis and the realization that there are circumstances that make it unfeasible to maintain an effective and fully coherent technical defense with the quality, independence and legal rigor that inspire the professional practice of this office.”

Clean Hands Accused Gómez of Leveraging Her Position

The case against Gómez originated from a complaint filed by Clean Hands in April 2024, based on press reports, alleging she used her position as the prime minister’s wife to benefit business leaders, including Juan Carlos Barrabés, who is currently under investigation.

Clean Hands accused Gómez of five alleged crimes: influence peddling, corruption in the private sector, misappropriation of funds, intrusion, and embezzlement of public funds. The organization alleges Gómez improperly leveraged her connections to favor individuals like Barrabés.
