Viña del Mar Festival: YouTuber’s Review Removed Over Copyright Claim

YouTube personality César Huispe, known for his channel Críticas Qls, is facing a copyright dispute after a video reviewing performances from the recent Festival de Viña, produced by Mega, was removed from the platform.

Huispe had posted a video ranking the comedians’ routines from the festival, and it quickly gained traction. However, less than 24 hours after its release, the review was taken down.

On Sunday, Huispe took to social media to accuse the Municipalidad de la Ciudad Jardín (the city’s municipality) of misusing copyright claims to suppress his criticism. The incident highlights the ongoing tension between content creators and established institutions regarding fair use and artistic critique.

“I’ve been on YouTube for 12 years, so I realize how copyright works, and they filed a false claim against me,” Huispe stated in a series of Instagram stories.

He continued, “They took the video down at 10 p.m. … These guys are so shady… I hate being right,” adding a laugh.

Críticas Qls vs. Viña

In his video, Huispe ranked the comedians’ performances at this year’s Festival de Viña, naming Stefan Kramer’s show as the weakest and praising Asshka Sumathra’s routine as the best.

Despite the video being a commentary and not a replacement for the original content, the municipality claimed copyright infringement. Huispe countered that he used the images appropriately and did not violate platform policies.

According to Huispe, his video falls under the “fair use” doctrine, which allows for the use of copyrighted material for purposes such as criticism, commentary, and education, while still adding value.

“In this case, the municipality of Viña had to resort to filing a false claim, alleging that the entire video belongs to them, from minute zero to minute thirty-four. This represents clearly false… because I am primarily on screen,” he explained.

Huispe concluded by stating that “the video is already being appealed, and since the claim is false, it will be restored in a couple of days.”
