PSOL Asks for Investigation of Flávio Bolsonaro Over Bolsonaro ‘Vigil’

Brazilian authorities are investigating whether senator Flávio Bolsonaro played a role in attempting to obstruct justice following his father’s recent arrest.The inquiry, launched at the request of the leftist PSOL party, centers on a public gathering organized by the younger Bolsonaro despite it being cited as a factor in the former president’s preventative detention. The situation underscores the escalating legal scrutiny of the Bolsonaro family amid ongoing investigations into alleged attempts to undermine Brazil’s democratic institutions.

Brazilian lawmakers are seeking an investigation into Senator Flávio Bolsonaro over his role in organizing a public gathering following his father’s recent arrest. The move comes as authorities scrutinize whether the event was intended to potentially disrupt law enforcement efforts.

The leftist PSOL party in the Chamber of Deputies formally requested Saturday, February 24, that the Prosecutor General’s Office (PGR) investigate the younger Bolsonaro’s conduct. The request centers on a “vigil” he announced for the health of former President Jair Bolsonaro, who was taken into custody earlier that day.

Supreme Court Justice Alexandre de Moraes cited the planned vigil in his decision to order the preventative detention of the former president. Bolsonaro had announced the religious gathering on social media Friday, February 23.

Despite the vigil being a factor in the arrest, Flávio Bolsonaro reiterated the call for the event on Saturday, and it proceeded that evening near the condominium where his father was under house arrest.

According to the PSOL deputies, the vigil’s purpose appeared to be an attempt to mobilize supporters “with the potential to facilitate escape, as well as create congestion and unrest at the location where the precautionary measure was being carried out, with the potential objective of obstructing or hindering the actions of the Federal Police and the District Federal Penitentiary Police.”

The lawmakers are asking the PGR to investigate Flávio Bolsonaro for possible incitement to crime, obstruction of justice, acts that aim to impede or hinder the prosecution of a criminal organization, actions that threaten the Rule of Law, and promoting or facilitating the escape of someone under security measures.

The party also argues for an investigation into “repeated participation or collaboration with a criminal organization, given the modus operandi already recognized in other investigations and criminal actions.”

The parliamentarians believe Flávio Bolsonaro’s actions mirror a pattern attributed to the criminal organization under investigation, which, according to court decisions, has historically mobilized supporters to create disturbances for personal and political gain.

During Saturday’s vigil, Flávio Bolsonaro stated the event was not political, but rather a religious expression. “We are left with faith,” he said. He also indicated that lawmakers in Congress should mobilize in support of an amnesty project and “the unity of the right.”

Bolsonaro also criticized what he called the “absurd justification” used by Justice Alexandre de Moraes to justify his father’s preventative arrest.

According to the Supreme Court Justice, the event was, in reality, “a gathering of protesters disguised as a ‘vigil’ for the health of defendant Jair Messias Bolsonaro.” He linked Bolsonaro’s violation of his electronic ankle monitor to the religious gathering.

The Justice argued that the violation of the monitoring device represented a “very high risk to the effectiveness of the decreed house arrest” and to “the effectiveness of criminal law,” potentially facilitating the former president’s escape. The case underscores the ongoing political and legal challenges facing the Bolsonaro family following the former president’s recent detention.
