Estate proceedings underway for man wrongly convicted in 1996 Polish murder
Legal proceedings are ongoing to settle the estate of Tomasz Komenda, a man who spent 18 years in prison for a crime he did not commit. The case is being handled by the District Court for Wrocław-Śródmieście. According to a statement from the District Court, the first hearing took place on October 16, 2024, with subsequent hearings held on November 29, 2024, and February 19, 2025. No further hearing date has been set, as the proceedings are currently paused pending an expert opinion. “The files have been returned from the expert,” the court confirmed.
Komenda received millions in compensation after exoneration
In February 2021, Komenda was awarded 12 million złoty (approximately $3 million USD) in compensation and 811,533 złoty (approximately $200,000 USD) in damages for his wrongful imprisonment. Reports from last year indicated Komenda purchased three apartments with the funds, later transferring ownership of the properties to one of his brothers. He also reportedly left a will. The ultimate disposition of Komenda’s assets will be decided by the court. “The parties involved are Komenda’s former partner, representing their four-year-old son, and his eldest brother,” according to reporting from “Gazeta Wyborcza.” “It is unknown how much money remains. Komenda lived a lavish lifestyle.”
The Miłoszyce murder and Komenda’s wrongful conviction
Komenda was arrested in 2000 and convicted four years later of the rape and murder of 15-year-old Małgorzata in Miłoszyce. The crime occurred on the night of December 31, 1996, and January 1, 1997. The case garnered significant attention in Poland, highlighting flaws in the justice system. Komenda was exonerated by the Supreme Court in May 2018, following a re-examination of the evidence by two prosecutors who determined he had no involvement in the crime. A subsequent investigation led to the non-final conviction in September 2020 of Ireneusz M. and Norbert B., who were sentenced to 25 years in prison. In December 2021, the Wrocław Court of Appeal reduced Norbert B.’s sentence to 15 years. The Supreme Court rejected an appeal in 2023. Komenda died on February 21, 2024, at the age of 46, after battling cancer.
