Man Accused of Throwing Sandwich at Border Patrol Agent Goes to Trial in Washington, D.C.

Jury selection began today in Washington, D.C., for a man accused of throwing a sandwich at a federal Border Patrol agent in 2023.

The trial focuses on the incident that occurred when the agent was allegedly struck by the sandwich, described by one officer as smelling of “onions and mustard.” During opening statements, a Border Patrol officer testified the sandwich “exploded all over” upon impact, leaving noticeable mustard stains. The defendant, who has become known as the “sandwich guy,” has stated the prosecution’s case is “half-baked.”

The incident, while seemingly unusual, highlights the increasing instances of assaults against federal law enforcement officers, a concern that has been raised by the Department of Justice. The agent testified that the sandwich impacted him with significant force. As the U.S. Attorney’s Office for the District of Columbia notes, assaults on federal officers carry substantial penalties.

The defense is expected to argue the incident was not an intentional assault. Court proceedings are expected to continue throughout the week, with a verdict anticipated later this month.
