A dispute over less than a dollar led to a violent assault in Mbour, Senegal, culminating in a three-year sentence for Samba Ka, though he is likely to be released almost promptly due to time already served in pre-trial detention. The case, stemming from a 2022 bar altercation, underscores the potential for rapid escalation of conflict and the challenges facing Senegal’s judicial system regarding pre-trial detention lengths [[1]].Prosecutors had originally pursued an attempted murder charge, reflecting the severity of Pape Yade’s machete wounds, but a court ultimately reduced the charge to aggravated assault.

A man in Mbour, Senegal, has been sentenced to three years in prison for a violent assault that left another man with deep wounds, but will likely be released soon after serving time already in detention. Samba Ka was initially accused of attempted murder, but the charges were reduced to aggravated assault following a trial that concluded this week.

The incident dates back to 2022, stemming from a dispute after a night out at a local bar. According to court documents, Ka, also known as “Bathie,” and his longtime friend, Pape Yade, argued over a 500 CFA franc bill – roughly equivalent to $0.85 USD – each claiming the other owed it to them. The disagreement quickly escalated into a physical altercation.

Investigators say the situation turned violent when Ka allegedly attacked Yade with a machete. Yade sustained significant injuries to his right wrist, ear, feet, and thigh, with some wounds reaching up to five centimeters deep, according to medical records presented in court.

Following the attack, Ka fled the scene as witnesses reacted to the violence. Yade received emergency medical treatment for his injuries. After recovering, he filed a formal complaint against Ka, who was later apprehended by police and admitted to striking Yade, though he disputed the extent of the injuries.

During the trial, Ka attempted to downplay the severity of the attack, claiming Yade initiated the confrontation with a knife and that he only responded with a single blow. However, prosecutors argued this account was inconsistent with the medical evidence detailing multiple wounds.

The prosecutor had sought a 15-year prison sentence, arguing that Ka’s actions demonstrated a clear intent to kill, citing the number of blows, the violence of the attack, and the targeting of vital areas like the neck. The prosecutor also noted that Ka left Yade severely injured without providing assistance, and Yade’s life was saved only by the quick actions of bystanders. Details of the contentious proceedings were reported by Senenews.com.

Ka’s defense attorney, Me Sène, argued there was no intent to cause death, attributing the incident to alcohol and substance use, suggesting both men were impaired and not fully aware of their actions. The attorney characterized the event as a bar fight that spiraled out of control, advocating for the charges to be reduced to aggravated assault.

The criminal court ultimately sided with the defense, reclassifying the charges and sentencing Ka to three years in prison. Because he has already served more than three years in detention while awaiting trial, Ka is expected to be released in the coming days. The case highlights the potential for even minor disputes to escalate into serious violence.
